Auction bidders are usually required to be pre-registered with the auctioneer and to arrive at the auction with a non-refundable deposit in order to participate in the bidding process. All sales are final regardless of the appraised value or whether the buyer can get a loan on the property. Therefore, it would behoove a bidder to be knowledgeable of the local real estate market where the property is located. This can be accomplished by working with a Licensed Real Estate Broker that can assist you with an experienced decision regarding the value of the property. The winning bidder will forfeit their non-refundable deposit if they can not close escrow on the property.
There are 2 basic types of Real Estate Auctions, On Site Auctions and Online Auctions. In either case the auctioned real estate is acquired AS IS and WHERE IS so it would be a good idea to conduct a thorough on site inspection of the property prior to bidding. Your Licensed Real Estate Broker can assist you with this and can also contact a professional home inspection company for you.
On Site Real Estate Auctions are typically conducted by professional auctioneers that may or may not have a real estate license and are generally preferred by sellers. The auction bidding process can be conducted in either of the following 3 ways: Absolute Bid, Minimum Bid and Reserve.
In an Absolute Bid auction, the property is sold to the highest bidder regardless of the bid amount.
A Minimum Bid auction would define the amount required in order to submit the starting bid. The property is sold to the highest bidder that meets or exceeds the minimum bid amount.
A Reserve auction would allow the seller to set the amount required in order to finalize the sale. The property is sold to the highest bidder as long as it is at least equal to the reserve amount.
One significant point to keep in mind when you are bidding on a property is that the high bid is NOT the final sales price of the property. Someone has to pay the auction company and it is not the seller. The high bidder pays the auction company an amount usually equal to five percent (5%) to ten percent (10%) of the high bid. This will vary by auction company but for examples sake, if the high bid for a property is $300,000, the final sales price may be $330,000 (bid + 10%) which is the amount that would be reflected on the county records.
You must keep the final sales price in mind when you are bidding. Since you do not have a loan contingency you should not bid on a property unless you have a lender loan commitment for an amount certain. However, the lender's loan commitment will be contingent upon the property appraising at the final sales price. As mentioned above, you do not have an appraisal contingency at auction either. Consequently, if the property does not appraise for the final sales price, you will have to make up the difference with funds from another source, usually your bank account. Otherwise, you will forfeit your non-refundable deposit if you do not close the escrow.
